The EB-1A Green Card is an employment-based, first preference visa category specifically designed for individuals of extraordinary ability in fields such as art, education, science, or athletics. To be eligible for this visa, applicants must demonstrate extraordinary ability by meeting at least 3 out of 10 specific criteria or by providing evidence of a one-time achievement, like a Pulitzer, Oscar, or Olympic Medal. Additionally, they must show evidence of their intent to continue working in their area of expertise​.

How to Apply?

For the EB-1A Green Card, applicants can self-petition by filing Form I-140, Petition for Alien Worker, without needing a U.S. employer’s sponsorship. The application process includes submitting extensive documentation to support claims of extraordinary ability, and upon approval of Form I-140, the applicant can then file Form I-485 to adjust their status. In some cases, Forms I-140 and I-485 can be filed concurrently, which may lead to faster processing times​​​​​​​​​​​​.

Do You Qualify?

To be eligible for the EB-1A Green Card, you must demonstrate extraordinary ability. This can be achieved by meeting at least three of the ten criteria set by U.S. immigration authorities, or by providing evidence of a singular, significant achievement (like an Olympic Medal or an Academy Award). Evidentiary Criteria for EB1A Visa

(3) Published material about you, in professional or major trade publications or other major media, relating to your work in your field of endeavor

(4) Participation, either as an individual or as part of a panel, as a judge of the work of others in the same or an allied field of specialization for which classification is sought

(5) Original scientific, scholarly, artistic, athletic, or business-related contributions of major significance in your field of endeavor

(6) Authorship of scholarly articles in your field, in professional or major trade publications or other major media

(7) The display of your work in your field at artistic exhibitions or showcases

(8) You have performed in a leading or critical role for organizations or establishments that have a distinguished reputation

(9) You have commanded a high salary or other significantly high remuneration for services, in relation to others in your field

(10) You have achieved commercial successes in the performing arts, as shown by box office receipts or record, cassette, compact disk, or video sales.
